The BBC set up a new alias Instagram account in India after noticing the platform was pushing sexually suggestive content even when users had not searched for it. The account followed 10 such profiles and, in less than a week, Instagram began showing the alias account paid adverts featuring adult pornography. Days later, it was also shown adverts promoting child sexual abuse material.
The BBC Eye investigation found Instagram has been running paid adverts promoting child sexual abuse material in India, some of which linked users to Telegram channels where the material was offered for sale.
The India government immediately sought an explanation on how advertisements containing such material were allowed on the platform. It directed META to immediately disable advertisements and content on Instagram that promote or facilitate child sexual abuse material. META has said it has a zero-tolerance policy on child sexual abuse material and is continuing to strengthen its detection and defences.
This disgusting story brings up a question asked so many times…why are these big powerful media companies not taking responsibility for content shown on this channels?
When they are caught out, the offensive material is deleted. But they do “publish” it in the first place and then respond when the complaints arrive.
META and similar type campaniles have many arguments arguing why they are not “publishers”, saying the scale and amount of the content makes publishing rules and responsibleness impossible. Traditional publishers review content before publication. Social media platforms process billions of posts, comments, videos, and images every day and they argue that their platforms cannot realistically review every piece of content before it appears. The companies argue their role is closer to providing communication infrastructure than approving individual messages.
Treating them as publishers could expose them to enormous legal liability. The BBC, CNN, Al Jazeera, ABC, Sky, TV and radio in NZ, newspaper, magazine and other print publishers in many parts of the world face the courts and pay large penalties when they break standards of behaviour set out in law and regulations. These media companies also have millions, maybe billions of viewers, each day.
